These Terms & Conditions govern the use of anchorcurve.com, the content and resources made available through the website and, where expressly applicable, digital products, educational content, memberships and other services offered by dk Consulting GmbH.

Separate terms, proposals, statements of work, order forms or other contractual documents may apply to consulting, implementation, corporate training and other individually agreed professional services. In the event of a conflict, the separately agreed contractual terms take precedence for the relevant engagement.

2. Website Use

anchorcurve.com provides information about dk Consulting GmbH, its services and activities as well as educational and professional content relating to artificial intelligence, AI strategy, organisational transformation, AI education, automation, AI agents, AI development and implementation, and related business and technology topics.

You may use the website only for lawful purposes and in a manner that does not infringe the rights of dk Consulting GmbH or any third party.

You may not attempt to interfere with the operation or security of the website, gain unauthorised access to systems or data, introduce malicious software, systematically scrape or extract protected content, or otherwise misuse the website.

3. Informational and Educational Content

Content published on anchorcurve.com is provided for general informational and educational purposes.

While we aim to use reliable sources and to provide accurate and useful information, we do not warrant that all information, data, statistics, analyses, estimates, opinions or other content is complete, accurate, current or suitable for every individual, organisation, industry or situation.

Artificial intelligence, technology, regulation, markets and business practices evolve rapidly. Information that was accurate when published may subsequently become outdated.

Analyses and conclusions published by anchorcurve may be based on particular assumptions, datasets, research methodologies, surveys, samples, publications or third-party information. Results and observations derived from such sources may not be universally applicable.

Users are responsible for evaluating whether information provided on the website is appropriate for their particular circumstances before relying on or acting upon it.

4. No Regulated Professional Advice

Unless expressly agreed as part of a separate professional engagement, content made available through anchorcurve.com does not constitute legal, tax, accounting, financial, investment, medical, cybersecurity or other regulated professional advice.

Nothing published on the website should be treated as a substitute for advice from an appropriately qualified professional where such advice is required.

5. Third-Party Information, Sources and Links

anchorcurve may refer to data, research, publications, statistics, opinions or other information produced by third parties.

We aim to identify and reference third-party sources appropriately. However, we do not control the preparation, methodology, accuracy, completeness or continued availability of third-party information and cannot guarantee its accuracy.

The website may also contain links to websites, platforms, tools or resources operated by third parties.

Such links are provided for information or convenience. Third-party websites and services are operated independently and are subject to their own terms, policies and practices.

The inclusion of a link or reference does not necessarily constitute endorsement of all content, statements, products or services provided by the relevant third party.

6. Intellectual Property

Unless otherwise stated, anchorcurve.com and the content made available through it, including text, graphics, designs, branding, illustrations, videos, frameworks, methodologies, course materials, presentations, templates and other materials, are owned by or licensed to dk Consulting GmbH and are protected by applicable intellectual-property laws.

You may access and use publicly available website content for personal or internal business purposes.

Unless expressly permitted by these Terms or by dk Consulting GmbH in writing, you may not:

- reproduce or republish substantial parts of the website or its content
- sell or commercially exploit anchorcurve content
- represent anchorcurve content as your own
- remove copyright notices, branding, attribution or other proprietary notices
- create or distribute commercial products substantially derived from anchorcurve materials
- systematically scrape, extract or create databases from protected website content; or
- use protected anchorcurve materials to provide competing commercial products, training or services

7. Free Downloads and Resources

anchorcurve may make reports, guides, templates, checklists, prompts, presentations or other resources available free of charge.

Unless otherwise stated for a particular resource, you may:

- download and use the resource for personal or internal business purposes; and
- share an unmodified copy of the resource with other persons for non-commercial purposes

When sharing a resource, all anchorcurve branding, copyright notices, source references and other attribution must remain intact.

You may not, without our prior written permission:

- sell a free anchorcurve resource
- charge others for access to it
- sublicense it
- include it in a paid product, course, database or service
- remove or replace anchorcurve branding or attribution
- materially modify it and distribute the modified version as an anchorcurve resource; or
- represent the resource or its contents as your own work

Where a specific resource contains different licence terms, those specific terms take precedence.

8. Information Submitted by Users

Users may submit information to us through contact forms or other communication channels. You are responsible for ensuring that information you submit is lawful and that you are entitled to provide it.

Unless specifically requested through an appropriate channel, you should not submit confidential third-party information, trade secrets, passwords, authentication credentials, special categories of personal data or other highly sensitive information through general website forms.

Submitting an enquiry through the website does not by itself establish a consulting, advisory or other professional relationship with dk Consulting GmbH.

9. Website Availability

We aim to keep anchorcurve.com available and functioning properly but do not guarantee continuous, uninterrupted or error-free access.

We may modify, update, suspend or discontinue parts of the website, features or content where reasonably necessary.

10. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Subject to mandatory law, dk Consulting GmbH is not responsible for decisions or actions taken solely in reliance on general informational or educational website content where such content was not provided as part of a separately agreed professional engagement.

Users remain responsible for evaluating information and determining its suitability for their individual or organisational circumstances.

Mandatory statutory rights and liability provisions remain unaffected.

11. Age

The website, professional services and commercial offerings of anchorcurve are intended primarily for adults and business users.

Paid products and services may only be purchased by persons aged 18 or older unless expressly stated otherwise.

12. Paid Digital Products and Educational Services

Where offered, anchorcurve may provide paid digital products and educational services, including online courses, training programs, memberships, subscriptions, digital resources or access to online learning environments.

The specific scope of each offering, including its content, price, access period, included services and any relevant technical requirements, is described on the applicable product, offer or checkout page.

The information displayed for the specific offering forms part of the applicable contractual terms.

13. B2B and B2C Customers

Paid offerings may be available both to consumers and to businesses.

A consumer is a person entering into the relevant transaction predominantly for purposes outside their trade, business or profession.

A business customer purchases the relevant offering in connection with its business or professional activity.

Where mandatory consumer-protection law applies, nothing in these Terms limits or excludes rights that cannot legally be waived or restricted.

14. Formation of Contract

Unless expressly stated otherwise, the presentation of a paid product or service does not itself constitute a binding offer by dk Consulting GmbH.

The exact process by which a contract is formed will be displayed during the applicable ordering or checkout process.

Before placing an order, customers will be given an opportunity to review the relevant product, price and contractual information and to correct input errors where technically provided.

Where these Terms form part of the purchase contract, they will be made available to the customer before the order is completed.

Separate terms of a platform, merchant of record or payment provider may additionally apply where the transaction is processed through a third-party platform.

15. Prices and Payments

The applicable price and, where relevant, the billing interval will be displayed before the customer places an order.

Where legally required, prices displayed to consumers will include applicable taxes or the checkout will clearly indicate how applicable taxes are added.

Payments may be processed through third-party payment or commerce providers, including providers such as Skool or Stripe, depending on the relevant offering.

Where a third-party platform acts as merchant of record or otherwise assumes responsibility for the payment transaction, the checkout will identify the applicable payment or contracting arrangement and the relevant third-party terms may also apply.

dk Consulting GmbH does not receive or store full payment-card credentials where those credentials are processed directly by the relevant payment provider.

16. Access to Digital Products
‍
Access to a digital product, course, membership or learning environment is provided for the period specified in the relevant offer.

Unless the relevant offer expressly states otherwise, the purchase of access does not provide lifetime access.

Access rights are personal to the customer or, in the case of an expressly agreed business or team licence, limited to the authorised users covered by that licence.

Customers may not share login credentials with unauthorised persons or provide third parties with access to paid materials without permission.

17. Subscriptions and Recurring Payments

Certain products or services may be offered on a recurring subscription basis.

Before a subscription is purchased, the applicable checkout or product page will specify:

- the billing interval
- the applicable price
- the initial contractual term, if any
- whether the subscription renews automatically
- the renewal period
- applicable cancellation conditions; and
- any minimum contractual commitment.

Where a subscription automatically renews, customers may prevent future renewal in accordance with the cancellation conditions disclosed for the relevant subscription and mandatory applicable law.

Cancellation ordinarily prevents future renewal and does not retrospectively cancel a period for which access has already been purchased, unless mandatory law provides otherwise.

For consumers, any automatic renewal mechanism and related notification or cancellation process will be operated in accordance with mandatory consumer-protection requirements.

18. Consumer Right of Withdrawal

Consumers may have a statutory right to withdraw from contracts concluded at a distance, including online contracts.

Where a statutory right of withdrawal applies, the applicable withdrawal information will be provided to the consumer before the contract is concluded.

For digital content that is not supplied on a tangible medium, immediate access may be provided before expiry of the statutory withdrawal period only where the applicable legal requirements are fulfilled.

Where required, the consumer will be asked separately to:

- expressly consent to supply of the digital content beginning before expiry of the withdrawal period; and
- acknowledge that beginning supply under the applicable statutory conditions results in the loss of the right of withdrawal

Where all legal requirements for the loss of the withdrawal right are satisfied, the consumer can no longer withdraw from the relevant digital-content contract after supply has begun.

Different rules may apply to services, subscriptions, memberships, live training and other offerings depending on their nature and how they are performed.

Nothing in these Terms removes a statutory withdrawal right where the legal requirements for its loss or exclusion have not been fulfilled.

19. Refunds

Except where:

- mandatory law provides otherwise
- a statutory withdrawal or other consumer right applies
- the relevant offering expressly provides a refund guarantee; or
- dk Consulting GmbH expressly agrees otherwise,

payments for digital products, access periods, memberships and educational services are non-refundable after the relevant statutory withdrawal rights have expired or have been validly lost.

No voluntary refund entitlement exists merely because a customer did not use the purchased content, did not complete a course, changed their mind after the applicable withdrawal right ceased to exist, or did not achieve a particular expected outcome.

Mandatory rights relating to defective or non-conforming digital content or services remain unaffected.

20. Course and Educational Content

Educational products are intended to provide information, frameworks, skills, examples and practical guidance.

Individual results vary and depend on factors outside our control, including the participant’s experience, circumstances, effort, implementation, organisation, technology environment and business context.

Purchase or completion of an anchorcurve course does not guarantee a particular financial, commercial, productivity, employment or other outcome.

21. Intellectual Property in Paid Content

Purchasing a course, membership, subscription or other digital product grants the customer only the usage rights expressly described in the applicable offer.

Unless expressly stated otherwise, the customer receives a limited, non-exclusive and non-transferable right to access and use the purchased materials for personal learning or internal business purposes during the applicable access period.

Ownership of intellectual-property rights remains with dk Consulting GmbH or the relevant licensor.

Paid materials may not be copied, redistributed, resold, published, sublicensed, shared with unauthorised users, used to create competing training products or commercially exploited without prior written permission.

22. Suspension of Access

We may suspend or terminate access to a digital product or service where reasonably necessary if a user:

- materially breaches these Terms
- shares access credentials without authorisation
- unlawfully distributes protected content
- attempts to compromise the security or operation of the platform
- uses the service unlawfully; or
- infringes the intellectual-property or other rights of dk Consulting GmbH or third parties

Any mandatory rights of consumers remain unaffected.

23. Third-Party Platforms

Some products or services may be delivered through third-party platforms such as online learning, community, video, payment or communication providers.

Use of those services may additionally be subject to the relevant third party’s terms and privacy policies.

We are not responsible for outages, technical restrictions or changes to third-party platforms that are outside our reasonable control, subject to mandatory statutory rights concerning the product or service purchased from us.

24. Professional Services

Consulting, AI implementation, corporate training and other individually negotiated professional services are not governed solely by these website Terms.

The commercial scope, deliverables, responsibilities, fees, payment terms, intellectual-property arrangements, confidentiality obligations, liability provisions and other terms of such engagements will be set out in the applicable proposal, statement of work, contract or other individually agreed documentation.

25. Governing Law and Jurisdiction

These Terms are governed by Austrian law, excluding its conflict-of-law rules and, where applicable, the United Nations Convention on Contracts for the International Sale of Goods.

For transactions between businesses, the courts having jurisdiction at the registered office of dk Consulting GmbH in Vienna, Austria shall have jurisdiction to the extent permitted by law.

For consumers, this choice of law and jurisdiction does not deprive the consumer of mandatory protections or jurisdictional rights available under applicable law.

26. Changes to These Terms

We may amend these Terms from time to time to reflect changes to the website, our products or services, our business model or applicable requirements.

Changes do not retroactively alter an existing paid contract unless legally permitted and appropriately agreed or otherwise provided by mandatory law.

The current version and its last-updated date will be published on anchorcurve.com.

27. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by applicable law.

For consumers, this provision does not replace or restrict any mandatory statutory rule concerning the consequences of an invalid contractual term.
